Terms of Service

These Terms of Service ("Terms") govern your access to and use of the StrideCue mobile application, Apple Watch companion app, and related services (collectively, the "Service") operated by StrideCue ("we," "us," or "our").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Eligibility

You must be at least 16 years old to use the Service. By using the Service, you represent that you are at least 16 years of age and have the legal capacity to enter into these Terms. If you are between 16 and 18 years old, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

  • Provide accurate and complete information when creating your account.
  • Keep your login credentials secure and not share them with others.
  • Notify us immediately if you suspect unauthorized access to your account.
  • Accept responsibility for all activity on your account.

3. The Service

StrideCue provides AI-powered running coaching through your Apple Watch and AirPods. The Service includes personalized training plans, real-time voice coaching, post-run analysis, and adaptive performance recommendations.

We may modify, suspend, or discontinue any part of the Service at any time. We will make reasonable efforts to notify you of material changes that affect your use.

4. AI Coaching and Health Disclaimer

The Service is not a medical device and does not provide medical advice, diagnosis, or treatment.

Our AI features, training plans, and coaching guidance are designed to support your running and fitness goals, not to replace professional medical advice, diagnosis, treatment, or individualized clinical judgment. Specifically:

  • AI-generated outputs may be incomplete, inaccurate, or inappropriate for your specific health circumstances.
  • You are responsible for using independent judgment and obtaining professional medical advice before starting any exercise program, especially if you have existing health conditions.
  • The Service does not diagnose medical conditions, prescribe treatment, or serve as a substitute for consultation with a qualified healthcare provider.
  • The quality and accuracy of coaching recommendations depend on the data available, including information you provide (such as age, weight, fitness level, and goals) and data from your Apple Watch. Inaccurate or incomplete input data may result in less effective coaching.
  • We will not use solely automated decision-making with legal or similarly significant effects on you unless we clearly disclose that practice and provide any rights required by law.

5. Physical Activity Risks

Running and physical exercise involve inherent risks, including the risk of injury, illness, or death. By using the Service, you acknowledge and accept these risks and agree that:

  • You are voluntarily participating in physical activities and assume all associated risks.
  • You should consult a physician before beginning any new exercise program, particularly if you have pre-existing health conditions.
  • You are solely responsible for your safety during exercise. Always be aware of your surroundings, follow traffic laws, and stop exercising if you experience pain, dizziness, or discomfort.
  • StrideCue is not liable for any injury, harm, or loss that may result from your use of the Service or participation in physical activities.

6. Subscriptions and Payments

Certain features of the Service may require a paid subscription. If you purchase a subscription:

  • Payment is processed through Apple's App Store. All transactions are subject to Apple's terms and conditions.
  • Subscriptions automatically renew unless you cancel before the end of the current billing period.
  • You can manage or cancel your subscription through your Apple ID settings at any time.
  • Refunds are handled according to Apple's refund policy.
  • Your use of the Service is also subject to Apple's Licensed Application End User License Agreement (EULA). In the event of any conflict between these Terms and Apple's EULA, Apple's EULA will govern to the extent required by Apple.

7. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of these Terms.
  • Attempt to reverse engineer, decompile, or disassemble the Service or its underlying technology.
  • Interfere with or disrupt the Service, servers, or networks connected to the Service.
  • Use automated scripts, bots, or other means to access the Service.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
  • Share, resell, or redistribute access to the Service without our written consent.

8. Intellectual Property

The Service and all associated content, features, technology, and branding are owned by StrideCue and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial purposes.

You retain ownership of any data you provide to the Service. By using the Service, you grant us a limited license to use your data solely to provide and improve the Service as described in our Privacy Policy. We do not claim ownership over your personal data, health data, or fitness data.

9. Feedback and Suggestions

If you provide us with feedback, ideas, or suggestions about the Service ("Feedback"), you grant us a non-exclusive, worldwide, royalty-free, perpetual license to use, modify, and incorporate that Feedback into the Service without any obligation to you. This does not apply to your personal data or health data, which is governed by our Privacy Policy.

10. Third-Party Services

The Service may integrate with third-party services such as Apple HealthKit, Apple Watch, and other fitness platforms. Your use of these integrations is subject to the respective third-party terms and privacy policies. We are not responsible for the practices or content of third-party services.

11. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the Service will be uninterrupted, error-free, or free from harmful components. AI-generated coaching recommendations are based on available data and algorithmic analysis, and we do not guarantee their accuracy, completeness, or suitability for your circumstances.

12. Limitation of Liability

To the maximum extent permitted by applicable law, StrideCue and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of the Service.

Our total liability for any claims arising under these Terms shall not exceed the amount you have paid us in the twelve (12) months preceding the event giving rise to the claim.

Consumer rights preserved. Nothing in these Terms limits rights that cannot be waived under the law of your place of residence. Any limitation of liability does not apply to death or personal injury caused by negligence, fraud, willful misconduct, unlawful processing of personal data, or any liability that cannot lawfully be excluded.

13. Indemnification

You agree to indemnify and hold harmless StrideCue from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.

14. Dispute Resolution

We encourage you to contact us first at support@articlecast.ai to resolve any dispute informally. Most concerns can be resolved quickly this way.

If a dispute cannot be resolved informally within 30 days, it shall be resolved through binding arbitration administered by a recognized arbitration organization, except that you may bring qualifying claims in small claims court. The arbitration shall be conducted in English.

EEA, UK, and Swiss residents: if you are a resident of the European Economic Area, the United Kingdom, or Switzerland, these arbitration provisions do not apply to you. You may bring claims before the competent courts of your country of residence, and nothing in these Terms affects your rights as a consumer under mandatory consumer protection laws.

Opt-out right: you may opt out of arbitration by notifying us in writing within 30 days of first accepting these Terms. Opting out will not affect other provisions of these Terms.

15. Class Action Waiver

To the extent permitted by applicable law, you and StrideCue agree that any disputes will be resolved on an individual basis and not as part of a class, consolidated, or representative action. This waiver does not apply where prohibited by the law of your place of residence, including for EEA, UK, and Swiss residents.

16. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service if you violate these Terms or if we reasonably believe your actions may harm StrideCue, other users, or third parties.

Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination will remain in effect, including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution.

17. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you through the Service or by email. Your continued use of the Service after the updated Terms take effect constitutes your acceptance of the changes. If you do not agree to the updated Terms, you should stop using the Service and delete your account.

18. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles.

EEA, UK, and Swiss residents: if you are a consumer resident of the European Economic Area, the United Kingdom, or Switzerland, you will benefit from any mandatory provisions of the law of your country of residence. Nothing in this section deprives you of the protection afforded by those mandatory provisions, and any disputes may be brought before the competent courts of your country of residence.

19. Notices

We may send you legal notices via email to the address associated with your account, through in-app notifications, or by posting updates on our website. It is your responsibility to keep your email address current. Notices from us are considered received when sent by email, when made available in the app, or 24 hours after being posted on our website, whichever occurs first.

20. General Provisions

  • Entire agreement: these Terms, together with our Privacy Policy, constitute the entire agreement between you and StrideCue regarding the Service.
  • Severability: if any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
  • Waiver: our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
  • Assignment: you may not assign your rights under these Terms without our prior written consent. We may assign our rights without restriction.
  • Force majeure: we are not liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including natural disasters, acts of government, internet or infrastructure failures, or pandemics.
